PLEASE READ THIS TERMS OF USE AGREEMENT (THE "TERMS") CAREFULLY. THESE TERMS GOVERN THE USE OF THE APPLICATION AND APPLY TO ALL USERS WHO UTILIZE VIRTUAL CURRENCY SERVICES, EXCHANGE SERVICES, AND E-WALLET SERVICES (COLLECTIVELY REFERRED TO AS "EXCHANGE SERVICES"), AS WELL AS OTHER SERVICES AND RESOURCES AVAILABLE OR ENABLED VIA THE APPLICATION OR WALLET (EACH A "SERVICE" AND COLLECTIVELY, THE "SERVICES") OR VIA OUR PARTNERS' SERVICES AS DESCRIBED BELOW. "ACCOUNT" REFERS TO AN ACCOUNT OPENED FOR YOU THROUGH OUR PARTNERS WHEN PROVIDING SERVICES.

 

This document regulates the terms and conditions for using Digital Lamp Exchange Services by Users. The Digital Lamp Exchange Service is provided by Digital Lamp sp. z o.o., located at ul. Hoża 86/210, 00-682 Warsaw, Poland (hereinafter referred to as the "Operator").

 

Before using the Services, please be aware that any activities related to the exchange of units in distributed cryptographic ledger systems (hereinafter referred to as "cryptocurrencies") and tokens (entitlement instruments equivalent to certain values), including but not limited to buying, holding, or investing in cryptocurrencies or tokens, involve certain risks.

 

The value of cryptocurrencies or tokens can fluctuate significantly, and there is a high risk of economic loss associated with such activities. By using any of the Services provided, you acknowledge and accept these risks and release the Operator from any liability for losses resulting from the use of these Services, to the fullest extent permitted by applicable law.

 

§1. Provision of Services

 

1. The Operator provides Services after the completion of the registration and Wallet setup process. The Services are available to:

   - Natural persons with full legal capacity (individuals over 18 years old).

   - Other entities with legal capacity regulated by applicable laws. 

   These users must accept these Terms of Use and enter into a service provision agreement (hereinafter referred to as the "User").

 

2. By accepting these Terms, the User declares that they:

   - Understand the risks associated with buying, holding, or investing in cryptocurrencies and tokens, including the possibility of losing all funds due to sudden market changes.

   - Acknowledge the risk of unauthorized access to their device and sensitive data, which could result in theft of funds.

   - Have full legal capacity.

   - Possess valid authorization to act on behalf of another entity (if applicable).

   - Provide truthful, accurate, and current information.

   - Are not located in the USA, are not U.S. residents, and do not act on behalf of entities with offices in the USA or countries where accessing the Services is illegal.

   - Are not listed by FATF or on EU sanctions lists.

   - Have never had their account suspended or removed for any reason.

 

3. The Operator strives to maintain uninterrupted service but reserves the right to suspend the Service for updates or unforeseen circumstances. The Operator will minimize service disruptions.

 

4. The Service requires a device with internet access and an updated browser supporting HTML5 and CSS3 (e.g., Google Chrome, Mozilla Firefox, Opera, Microsoft Edge). For mobile devices, Android 5.0+ or iOS 10.0+ is required.

 

5. Users must use the Service lawfully and ethically. Users must not:

   - Share illegal content or infringe upon intellectual property rights.

   - Disrupt or compromise Service operations.

   - Provide false information to the Service or other Users.

   - Exploit the Service in bad faith.

   - Use the Service for illegal purposes or in violation of these Terms.

 

6. Except for third-party trademarks, all Service content, including source code and graphics, is the intellectual property of the Operator or third parties. Unauthorized use is prohibited.

 

7. By agreeing to these Terms, Users also agree to the terms of third-party partners (e.g., 2PAYAPP Limited, Quppy Europe OU, Sutor Bank, and Bluecode Software).

8. The Operator may refuse, limit, or suspend accounts or transactions at its discretion.

 

9. Users consent to the processing of their data outside the EU, where applicable.

 

§2. Account Registration

 

1. Users must register an account free of charge by providing accurate information and accepting the Terms of Use and Privacy Policy.

 

2. Upon completing registration, Users must confirm their account via a link sent to their email and set a secure password. Once confirmed, the service agreement becomes effective.

 

3. Users are responsible for safeguarding their passwords. The Operator is not liable for losses resulting from Users' failure to secure their data.

 

4. Users must keep their account information up to date. The Operator may block accounts with outdated or suspicious information.

 

5. The Operator may refuse account registration if any information provided is false or misleading.

 

§3. Verification and Compliance

 

1. To access full account functionality, including paid services, Users must complete Anti-Money Laundering (AML) and Know Your Customer (KYC) verification procedures.

 

2. Verification may require providing:

   - Full name, citizenship, address, tax residency, political exposure, phone number, date of birth, and ID number (for individuals).

   - Company registration documents and beneficial ownership details (for businesses).

 

3. Users must provide clear, unaltered scans/photos of identity documents and, if requested, a selfie holding their ID.

 

4. Proof of address must be recent (within 6 months) and may include utility bills, bank statements, or official letters.

 

5. The Operator may request updated verification at any time to comply with legal obligations.

 

6. The Operator processes personal data for service provision, legal compliance, and security purposes. Details are in the [Privacy Policy](https://trade.DigitalLamp.exchange/legal/privacy-policy).

 

§4. Fees and Transactions

 

1. Transaction fees are automatically deducted upon processing. Fee details are available in the fee schedule.

 

2. The Operator may change fees without modifying the Terms of Use.

 

3. The Operator does not guarantee profits from cryptocurrency exchange rates.

 

4. Cryptocurrency transactions are visible in the User account upon confirmation.

 

5. Users are prohibited from using the Service for business activities or accepting third-party payments into their wallets.

 

§5. Liability

 

1. The Operator limits liability to the fullest extent permitted by law. This includes:

   - Delays in transaction processing.

   - Service interruptions.

   - Financial losses from exchange rate fluctuations.

   - Technical issues caused by Users' devices or internet connections.

 

2. The Operator is not liable for losses due to force majeure, system failures, or third-party actions.

 

3. Users are responsible for damages resulting from misuse of the Service.

 

§6. Agreement Termination

 

1. Either party may terminate this agreement with five (5) days' notice. The User must withdraw all funds and close all transactions before termination.

 

2. The Operator may terminate the agreement immediately for breaches, including failed identity verification or suspected money laundering.

 

3. The Operator may block accounts and funds if legal violations are suspected.

 

4. Users will be notified of changes to the Terms seven (7) days in advance. Non-acceptance requires discontinuation of the Services.

 

§7. Complaints

 

1. Users can contact the Operator at info@digitallamp.pl.

 

2. Complaints must be submitted via support@digitallamp.pl, including:

   - The complaint's subject.

   - Relevant details.

   - A proposed resolution.

 

3. Complaints will be processed within 14 days. Incomplete complaints will require additional information.

 

§8. Governing Law

 

1. These Terms are governed by Polish law.

 

2. Disputes will be resolved by Polish courts.

 

3. If any provision is invalid, the remaining provisions remain effective.

 

4. The Operator may assign its rights and obligations to another entity without User consent.
